Puply Terms & Conditions

GENERAL CONDITIONS

In the Terms and Conditions the following definitions apply:

a) “Company” means Puptails UK Ltd Trading as Puply.

b)“Customer” means any person that has purchased or made use of one of our yoga classes or events.

c)“Studio” means any and all of the physical spaces that are occupied and part of Puply, this includes yoga studios, reception and sitting area, change rooms, corridors, office, and all storage and team areas.

d)“Yoga packages” means any item that provides the client with access to our products/services or studio facilities.

e)“Products/services or studio facilities” means any of the yoga studios open to, or products/services offered to clients of the company as published on our website(s).

f)“Terms and Conditions” are as defined here.

g)“Website” means puply.io or affiliated websites.

The Terms and Conditions are incorporated into the online booking system.

The Company reserves the right to vary or revoke any of the Terms and Conditions from time to time which it may consider necessary or suitable for the regulation of the governance of the studio and the conduct of members. Any such changes will be published on our websites and, until revoked, are binding on members.
The Terms and Conditions shall be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

CLASS BOOKING, ARRIVAL & LATENESS POLICY:

Classes can be booked online up to six months in advance. We recommend arriving at the studio 10 minutes before the class. Where possible we will try to accommodate lateness up to 20 minutes after the start time of our events. We reserve the right to refuse entry for any lateness over five minutes.

LATE CANCELLATION/NO SHOW POLICY:

Cancellation and ticket changes are not accepted within a 72-hour period before the event. We will only provide refunds in the form of vouchers, up to the original purchase price.

We will not refund under any circumstance where a customer does not show.

AGE RESTRICTIONS:

Customers must be over 18 years of age to attend any of our sessions that include alcohol and 16 years of age to our events that do not include alcohol. Photo ID is required for entry.

FUNCTIONING OF OUR SERVICE:

Puply reserves the right to vary the class schedule and opening hours. These changes to the schedule will be published on www.puply.io.

We do not guarantee that the Service will be uninterrupted or error-free. We are entitled, without notice and without liability (a) to suspend the Service for repair, maintenance, improvement or other technical reason and (b) to make changes to the Service.   

You acknowledge that technology is not always secure and you accept the risks inherent in use of the Internet or other technology for the purpose of the Service.

CANCELLATION:

Cancellation of classes sessions due to unforeseen circumstances may occur. Puply reserves the right to cancel classes due to unforeseen circumstances that may occur.

Where possible we will look to provide 72h notice for any event cancellations. Historically, there have been a small number of events that we have had to cancel or postpone due to unforeseen circumstances.

In the event of postponement or cancellation, you will be provided a refund as a voucher to rebook for a future event.

Where we have cancelled or postponed an event and you are unable to attend either the new event date or any future date, we will issue a refund for your full order value.

We will not, however, compensate for airfare or travel costs incurred due to class cancellation. In the unlikely event that we must cancel a class due to force majeure (including but not limited to; weather, natural disaster or political upheaval) we cannot guarantee a refund.

Puply reserves the right, at its discretion, to change or modify the schedule or offer usage of a different studio/location.

The names of the tickets holders are checked before the class. The Company reserves the right to refuse a customer whose name is not registered on our system.

PERSONAL BELONGINGS:

Personal belongings are brought in the studio premises at the participant’s risk and Puply does not accept liability for any loss or damage whatsoever to such items.
For security reasons participants are advised to avoid bringing valuables to the class.

FITNESS & HEALTH:

Participants are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. Puply reserves the right to refuse access to any participant if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such facilities. Participants with the following conditions, but not limited to, should not attend class: low/high blood pressure, cardiac irregularities, surgery, and sprains or fractures. If there is any doubt, the participant should consult his/her healthcare provider first.

SAFETY & HYGIENE:

Smoking is not allowed anywhere on the premises. No crockery, glass or food is permitted in the changing rooms or yoga studio(s). Customers are requested not to walk around the Studio, changing rooms or showers barefoot if they have foot complaints (please wear flip flops). If you have any contagious foot complaints, please make sure you are wearing socks at all times.

Puply accepts no responsibility for any client who does not follow the instructed class or has not disclosed medical conditions or recent injuries to the teacher. Please be aware that it is your responsibility to inform the instructor if you feel unwell or any discomfort.

If you find that you are pregnant, please let us know as soon as possible as our classes may not be suitable for you. If you choose not to tell us or the teacher about your pregnancy, Puply will accept no responsibility for any injuries or issues that may occur as a result of doing a class.

Customers  must use the appointed entrance to the Studio when entering or leaving the Studio. Fire exits, which are clearly marked, are there in the interests of safety and Members must not interfere with these doors for any reason. In the event of a fire, Customers are asked to make their way to the nearest available exit.

GENERAL GUIDELINES:

Customers must at all times observe the Studio guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the smooth operation of the Studio for the convenience of all Customers. 

Customers are required to give written notice to the Company of any change of address, email or contact number. Failing such notice, all communications shall be assumed to have been received by the Member within 5 days of mailing to the last address notified to the Company. The Company reserves the right to refuse admission to our classes. A person who is not a customer has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any terms of our services or use any of the facilities provided by the company. 

The Company may, if a Customer so wishes, communicate with the Customer by electronic mail (“email”). By providing an email address to the Company, the Customer consents to receiving email communications from the Company, including notices pursuant to the Terms and Conditions. The Customer also accepts any risk that email may not be a fully secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Member in this manner.

LIMITATION OF LIABILITY:

If you are feeling unwell or you’re displaying any symptoms of COVID-19 then we ask that you do not attend the event, and stay at home in order to protect yourself and others. Full government guidance on how to best stay safe, and prevent the spread of COVID-19 can be found here.
In case of national lockdown, all attendees will be fully refunded no matter the notice.

PERSONAL INFORMATION & DATA PROTECTION:

Your personal information is secure and usage of your personal information is administered by Puply, which is part of these Terms & Conditions. We will use your personal information to provide you with use of our products, services and facilities as well as maintain our records, process applications and payments, verify your identity, do market research and gain feedback. Your information may be kept for a reasonable amount of time for the above reasons. Your information may be shared with third parties to comply with our legal or regulatory obligations, for the prevention of fraud or other crimes, and in the case of medical emergencies. By agreeing to our terms & conditions, you consent to the use of your information including sensitive information relating to your health & fitness, for the reasons & manner explained above.

CONSENT TO PHOTOGRAPHY/VIDEOGRAPHY

ACCEPTABLE USE OF OUR SERVICE

You agree not to do any of the following in connection with the Service:

a) breach any applicable law, regulation or code of conduct;
b) use the Service to provide a similar service to third parties or otherwise with a view to competing with us;
c) use the Service for junk mail, spam, pyramid or similar or fraudulent schemes;
d) do anything which may have the effect of disrupting the Service including denial of service attacks, worms, viruses, software bombs or mass mailings;
e) do anything which may negatively affect other Users’ enjoyment of the Service;
f) gain unauthorised access to any part of the Service or equipment used to provide the Service;
g) intercept or modify communications to or from the Service;
h) circumvent any security or other features of the Service including features that restrict use or copying of Content; or
i) attempt, encourage or assist any of the above.

You agree to:

comply with any rules or requirements on our Service;
b) promptly comply with any reasonable request or instruction by us in connection with the Service; and
c) ensure that any contact or other information which you supply to us is accurate and not misleading and you will tell us if there are any important changes.

YOUR CONTENT

You are responsible for your Content. We reserve the right without notice or refund to reject, suspend, alter, remove or delete Content or to disclose to the police or other relevant authorities or to a complainant any Content or behaviour if it is the subject of complaint or where we have reason to believe that it breaches our terms and conditions, or that such steps are necessary to protect us or others, or that a criminal offence may have been committed, or where required by law or where requested by the police or other appropriate authorities, or if we consider that Content does not meet our quality standards.  If so, you must not attempt to re-publish or re-send the relevant Content.

OTHER PEOPLES’ SERVICES / ADVERTISING / WEBSITES

We may display other peoples’ services, advertising and /or links to other websites. We do not recommend or endorse, nor are we legally responsible for, any of these.  You use them at your own risk.

RESTRICTIONS ON OUR LEGAL RESPONSIBILITY

Nothing in this agreement in any way limits or excludes our liability for negligence causing death or personal injury or for fraud or fraudulent misrepresentation or for anything which may not legally be excluded or limited. In this section, any reference to us includes our employees and agents, who have the right to enforce this agreement.

We shall not be liable for any loss or damage where:

a) there is no breach of a legal duty owed to you by us;

b) such loss or damage was not reasonably foreseeable (meaning it was not an obvious consequence of our breach or not contemplated by you and us at the time we entered into this contract);

c) (and to the extent that) such loss or damage is your fault, for example by not complying with this agreement; or

d) such loss or damage relates to a business of yours.

You will be liable for any reasonably foreseeable loss or damage we suffer including claims made by other people arising from your breach of this agreement or misuse of our Service (subject of course to our obligation to mitigate any losses).

INTELLECTUAL PROPERTY RIGHTS

The intellectual property rights in all material used on or in connection with our Service (including the videos) are owned by us or by our partners. For your personal use only, you may view such material on your device.  You must not otherwise use such material including copying, publishing, selling or adapting it or taking extracts from it without our specific prior written consent. You must not misrepresent the ownership or source of such material, for example by changing or removing any legal notices or author attributions. 

You must not collect, scrape, harvest, frame or deep-link to any Content on our Service without our specific prior written consent.

COVID 19:

PRIVACY

You acknowledge and agree that we may process your personal information in accordance with the terms of our privacy and cookies policy on our website, which is subject to change from time to time.

PUPPY BEHAVIOUR & OWNERSHIP NOTICE

Please be aware that whilst Puply has safety protocols in place to limit risks regarding boisterous puppies, they can sometimes become playful, overzealous and bite. Puply UK Limited takes no responsibility for injuries or death that arise from attending a Puply event. Puptails UK Limited disclaim any liability with regards to puppy behaviour. By purchasing tickets, you, and any guest you buy tickets for agree to this disclaimer. It is your responsibility as a ticket purchaser to ensure any guests that attend a Puply sessions are made aware of the Terms and Conditions generally but specifically to this disclaimer.

We do not “own, keep or train animals as part of our activities”. We partner with breeders who attend our events who have responsibility for their pups at our events. We have limited contact with the pups apart from those agreed with breeders prior to our classes delivered at our partner venues. The government guidelines regarding animal licensing activities and the local authority in which we operate, classify our activities as that of an “Agent” with regards to the exhibition of animals. We therefore do not require a license to run our events. We comply with all associated rules required of an “Agent”.
